Parking Enforcement - Privacy Notice

East Renfrewshire Council provides a range of enforcement duties to make sure that we meet our obligations to maintain and manage the public roads in the way that the law says that we must.

The enforcement we undertake is as follows:

• Issuing, collection and pursuing of Penalty Charge Notices (PCN's) issued because of parking contraventions.

To deliver this enforcement service we need to collect, store, use, share and dispose of personal information. This is known as data processing.

Our legal basis for processing your information is to perform a task in the public interest and which has a clear basis in law.

The processing of personal data for the purposes of parking enforcement is necessary to manage our legal responsibilities to manage and maintain the road network as prescribed by the Roads (Scotland) Act 1984..

We don't require your permission to process your personal information for parking enforcement as we have a legal obligation to fulfil our public tasks.

In situations where a parking penalty charge notice is not paid, the name and address of the registered keeper of the vehicle are obtained from the DVLA to allow us to generate statutory documents.

The personal information we hold about you about parking enforcement is collected in a variety of ways. We'll collect information from Enforcement Staff about your vehicle registration number and the date and time of the incident for which the enforcement action is taken. We will also collect information from the DVLA about the Registered Keeper of the vehicle if we require to pursue a PCN ticket. We only collect information that we need.

To meet our legal obligations, we'll sometimes share your personal information between teams within the Council, and with external organisations involved in delivering services on our behalf.

The Council may also provide personal information to third parties, but only where it's necessary, either to comply with the law or where permitted under data protection legislation.

Organisations who we may share your information with include

• Police Scotland
• DVLA
• Public and Private sector contractors engaged by the Council to undertake Parking Enforcement processing duties and for the purposes of debt collection.

We'll only share your information with partners or suppliers who have sufficient measures and procedures in place to protect your information and can meet their legal obligations under data protection legislation. These requirements will be set out in contracts or information sharing agreements.

We'll not keep your information for any longer than it is needed, and will dispose of both paper and electronic records in a secure way. The length of time we need to keep information collected for providing Transport and Infrastructure services varies and will depend on the purpose for which it is collected. The Council has a Record Retention Schedule which sets out how long we keep records and the reason why. Fixed Penalty Notices served by the Roads Authority are retained for 3 years after compliance with the notice.
